1. Legal Bases/General Information

1.1 The subject of the contract is the temporary provision of trekking camps for overnight stays.
1.2. These general terms and conditions apply to the contractual relationship between the guest and the Naturpark Südschwarzwald e. V./ Naturpark Schwarzwald Mitte/Nord e.V. (hereinafter referred to as nature park). The guest fully accepts these general Terms and Conditions and, with his booking on the internet, confirms acknowledgement of these general Terms and Conditions.
1.3 The trekking camps are part of the offer "Trekking Black Forest" of the Naturpark Südschwarzwald e.V. and Naturpark Schwarzwald Mitte/Nord and its cooperation partners.

The subject of the contract is the temporary provision of trekking camps for overnight stays.

2. Contract conclusion/Payment methods

2.1 With his electronic registration, the guest offers the respective nature park a binding contract for the use of trekking camps for overnight stays. 
2.2. The contract comes into effect when the nature park in question confirms the booking electronically to the guest.
2.3. Registration is done by the guest. The guest is liable for fellow travelers in accordance with the statutory provisions. The guest is therefore recommended to inform fellow travelers about these terms and conditions. The guest is liable for the fulfillment of the contract.
2.4. All prices are inclusive of VAT.
2.5. Unless agreed otherwise in writing, the total price must be paid by the guest immediately during the booking process via PayPal. After paying the usage fee, the guest receives the invoice by electronic means, which also serves as a booking confirmation. Upon request the guest is obliged to show the booking confirmation/invoice to the camp supervisor on site.
2.6. With the invoice, the guest will receive the exact location of the booked places in form of GPS data. We recommend using a GPS device.
2.7. Prices (as of 04.01.2024
): 15 euros (including VAT) per night for 1 tent with 3 people.

3. Services

3.1 The scope of the service to be provided is specified in the service description on the internet (www.trekking-schwarzwald.de), as well as the information contained in the respective booking confirmation.

3.2 The trekking camps can be booked for a maximum of one night during the period from 01.05. until 31.10. each year. However, the exact dates on which the individual trekking camps are accessible can vary for reasons of nature conservation and can therefore be viewed in the occupancy preview under the heading "Book now" on our website. The guest requires a valid booking confirmation in order to use the trekking camps (further details are specified in point 2).

3.3 Arrival at the trekking camp can take place from 5 p.m. on the day of the overnight stay. The trekking camp must be vacated by 10 a.m. at the latest.

3.4 The operators of the respective trekking camps are listed in the appendix to these terms and conditions.

4. Withdrawal/Termination/Rebooking/Cancellation/Force majeure

4.1 Up to 28th days prior to the booked overnight stay, the guest may withdraw from the contract free of charge. The declaration of withdrawal must be submitted in writing without stating grounds. 
4.2 If the customer withdraws after the 28th day before the agreed overnight stay, the withdrawal fee of the travel price for 5,00 Euro will be incurred
4.3 The nature park has the right to withdraw from the contract if there are urgent reasons to do so. Good cause include, in particular, force majeure and circumstances which were unforeseeable when the contract was concluded, endangering the life and limb of the guests. The nature park must inform the guest of this cancellation in writing or text form immediately after becoming aware of it. In this case, the guest does not have to pay a cancellation fee.

5. Liability

5.1 Guests and participants are advised that the forest floor of the trekking camps can be uneven and rooted and that there is a risk of falling or stumbling. Furthermore, branches, insects or other animals or other irregularities occurring in nature can cause injuries to the guest or damage the guest's belongings.
5.2 As a matter of principle, the guest waives the assertion of claims for damages of any kind against the nature park that arise in connection with the use of the trekking camp.
5.2.1 However, the waiver of liability does not apply to damage resulting from injury to life, limb or health due to a negligent breach of duty by the nature park or an intentional or negligent breach of duty by an employee or representative of the nature park.
5.2.2 The waiver of liability does not apply to other damages that are based on a grossly negligent breach of duty by the nature park or on an intentional or grossly negligent breach of duty by employees or representatives.
5.3 The guest is liable for any damage to the inventory, terrain and equipment (such as toilets, tent sites/platforms and fireplaces) of the booked trekking camp that was culpably caused by the himself or by other participants. Guests subject to supervision are liable for participants in need of supervision in accordance with the statutory provisions.
5.4 The guest is particularly liable for damage caused negligently or deliberately by himself or the participants due to careless handling of fire or lighting of fire in times of high forest fire risk. The guest is advised to obtain information online on the homepage of the German Weather Service at www.dwd.de regarding the current level of forest fire risk on the day prior to arrival.
5.5 The guest is liable for any damage to the inventory, property and equipment of the booked trekking camp as well as for personal injury that was culpably caused by the latter.

6. Obligations of the guest

6.1 With his booking, the guest accepts the rules governing the trekking camp, which are sent to him after bookig, as binding and also informs participants about the user regulations. Guests and participants must adhere to these regulations. In case of breach against these provisions, the camp attendant appointed to supervise the camp may exercise domiciliary rights over the respective trekking camp. Infringements will be reported to the authorities. Violations will be reported.

6.2 The guest must obtain information about the forest fire risk and severe weather warnings from the German Weather Service (“Deutscher Wetterdienst”) no later than the day before using the trekking camp. If the German Weather Service predicts the forest fire hazard level (the forest fire hazard index) 4 (high hazard) or 5 (very high hazard) for the relevant areas, the fireplace must not be used and no open fire must be lit. In addition, the fireplace may not be used if the camp supervisor has imposed a fire ban on site. This ban applies regardless of the current forest fire danger index.   

6.3 Fire may only be lit in the intended fireplace and only burn under constant supervision. When leaving the trekking camp, it must be ensured that the fire is completely extinguished.

7. Choice of law / place of jurisdiction

The law of the Federal Republic of Germany applies to this contract. Place of jurisdiction for fully qualified merchants, for people who do not have a general place of jurisdiction in Germany, for people who have moved abroad after the conclusion of the contract or whose domicile or usual place of residence is not known at the time the lawsuit is filed, and for passive legal proceedings, is the seat of the nature park. Both do not apply if international agreements prescribe something else.

 

8. Severability clause

The ineffectiveness of individual provisions of these General Terms and Conditions shall not result in the invalidity of the entire General Terms and Conditions. The ineffective provision shall be replaced by a provision which comes closest to the purpose of the invalid provision.
